Terms of Service Agreement | April 2, 2020
Terms: You (“ you”, “ your”, “ yours”, “ member”) have requested to enroll in, register, sign up or subscribe (collectively, “ Enroll” or “ Enrolled”) for a service or product provided by the CreditBot, Ltd. Liability Company, dba CreditBot® its parent companies, subsidiaries, affiliates, divisions, contractors and all data sources and suppliers (collectively, “ CreditBot”, “ we”, “ our”, “ us”).
Terms And Conditions
You must read these CreditBot terms and conditions (“Service Terms”) carefully before you Enroll and use the Services defined in this agreement. These Service Terms are a legally binding agreement between CreditBot and you and define the terms that you agree upon to use CreditBot Services. Examples of CreditBot active credit monitoring services and/or products may include credit analysis reports, credit health reports, corrective dispute letter summaries. Examples of credit-related services and/or products may include credit reports, credit changes, and tradelines Credit Monitoring, credit alerts and credit assistance (“Credit Services”). These examples and any other services or products that may be made available to you by CreditBot are collectively referred to as our Services. (collectively, “Services”).
Website Terms Or Use
The information on CreditBot websites (“Website” or Websites is intended as a convenience to provide you with information about our Services and a method to Enroll. Once you are Enrolled, you will have access to a password secured member website (“Member Site”) where you must go to access your Enrolled CreditBot Services. Access to the Member Site will continue if you are Enrolled and paying for Services. Your access to the Websites is provided “as is”. The Websites and Member Site may also be available as a full or partial featured version through your smart mobile phone.
The copying, framing, mirroring, scraping or data-mining of our Websites or any of its contents in any form or by any method is strictly prohibited. Access to our Websites does not grant you any right, license or privilege to reproduce, publish or use any material from the Websites or any property of CreditBot except as expressly set forth herein. Any ideas, concepts, techniques, procedures, methods, systems, designs, plans, charts or other materials you transmit to us through e-mail, phone, or our Websites will become our property and may be used by us at any time and for any purpose, without restriction, unless otherwise agreed by CreditBot.
By using our Websites, you agree not to restrict or inhibit anyone from using or enjoying our Websites. In your use of our Websites, you shall not knowingly nor negligently transmit any viruses, malware, trojan horses, worms, time bombs, cancelbots or other similar harmful or deleterious programming routines.
Electronic Agreement & Enrollment
When you Enroll, you represent that you are a natural person at least eighteen (18) years of age and residing in the United States or its territories. You further agree to provide CreditBot with personal information necessary to access and provide our Services to you. Some Services provide by CreditBot may include the option to enroll your minor children provided you are the parent or legal guardian.
Note: You Understand That it may be a violation of local, state and federal law for you to obtain a credit report for anyone other than yourself.
CreditBot reserves the right to refuse to allow you to enroll in certain circumstances that may apply to you such as a history of misusing our Websites, creating phony enrollments in an CreditBot Service, misusing CreditBot Service special offers, filing fraudulent credit card chargeback requests on a previous CreditBot Service or non-payment of Services.
To Enroll in an CreditBot Service you must visit an CreditBot Website or some other method we expressly permit. As a convenience to you, CreditBot may provide internet links to websites owned or operated by other entities and persons. If you use these websites, you do so at your own risk. CreditBot makes no warranties or representations regarding these websites, and shall not be liable or responsible for, any linked websites, your use of such sites, or the comprehensiveness or accuracy of information or materials appearing thereon or any products, publications, subject matter or services described thereon. Furthermore, links do not imply that CreditBot sponsors, endorses or is affiliated or associated with such sites, or that any linked website is authorized to use any registered mark, service mark, website look – feel – design, trademark, trade name, logo or copyright of CreditBot.
To start your Enrollment process (“Process”) you will need to click a Website button such as “start membership” from a CreditBot Website. The Process will prompt you to provide personal information such as your full name, birth date, residence address, email address, social security number, and payment card information. Entering and maintaining accurate information during and after Enrollment is critical to the accuracy and availability of the Services we provide to you. Examples of how inaccurate information may affect your CreditBot Services include; non-delivery of Service alerts due to an incorrect email address, inaccurate credit reports due to incorrect personal information or temporary deactivation of services due to failed charges associated with outdated payment card information. If your personal information changes, you must keep it up to date so that your Services are not negatively impacted. You may update your personal information from the Member Site or by calling CreditBot customer service. CreditBot is not responsible for the inaccurate personal information you enter that may affect your Services.
During the Process, you will be prompted to complete a one-time identity authentication. This authentication is required and involves answering online questions, that are provided by the credit bureau, to validate your identity before we provide access to your credit information. Provided that you complete this step and the payment of any fees successfully, you will then be considered a Member and will be eligible to access the Services which you have enrolled in.
If you do not successfully complete the identity authentication, you will be prompted to contact CreditBot customer service by phone at the soonest possible time to complete the process manually. If you do not complete your identity authentication within a reasonable period of time, CreditBot may place you in an alternate plan. This play may deliver as many benefits as possible without an identity authentication at a reduced price reflecting the reduction in benefits. This plan is intended to assure you that you are not without the basic identity theft monitoring protection services you expected. You will have limited access to the credit monitoring alert benefit. As an example, any personal information or credit monitoring details provided from the credit bureau through a credit monitoring alert may not be available to you. Once you have successfully completed the identity authentication, you may upgrade your account to any available plan by logging into your member website or calling the CreditBot client care.
Finally, the enrollment process will provide you with a summary of the services you are purchasing, their cost, terms and any special offer details.
In some cases, your Services terms may include group discounts, employee discounts, special or introductory offers (“Offer”). If your Enrollment includes one of these Offers it will be represented to you during the Website Enrollment Process. Depending on the Offer, it may be:
Introductory Offer – These offers are intended to allow first-time customers to try our Services under special terms such as a reduced cost for a period of time. The following will apply:
- Your welcome email will include a description of your services, a receipt and further information on how may cancel your services.
- Services associated with you purchase may be made available to you immediately upon the successful completion of your enrollment and identity authentication.
- After the introductory offer expires, your Services will convert automatically to the regular price as set forth during your Enrollment and found in your Member Site. When required, you may be notified in advance by email. Upon the completion of any introductory offer, all normal terms and conditions outlined in this agreement will apply. All other Service plan terms specific to your purchase would apply.
Group / Employee Discounts (collectively “Benefits”) – These offers are intended to allow groups or employees of a participating business to enroll in our Services under special terms such as a reduced group cost. When you enroll online, the Plan, fee (if any) and effective date of your services will be disclosed to you. All other terms and conditions outlined in this agreement will apply.
Services & Products
CreditBot Services are offered in plans ( Plan or Plans) that generally include one or more benefits or features Benefits Certain individual Services such as a credit report may also be offered as a one-time or one-shot purchase A la carte .Each plan may contain a different arrangement of Benefits. To determine which Plan or A la carte purchases you are enrolled in, see the list in your member portal.
ANY PERSON USING DECEPTION TO KNOWINGLY AND WILLFULLY OBTAINS A CONSUMER CREDIT REPORT, SCORE, CREDIT SERVICES OR SCORE MAY FACE CRIMINAL PROSECUTION.
Some Plans may provide you with the availability of credit related services active credit monitoring . This may include but is not limited to accessing your credit report(s) from SmartCredit with one or more credit bureaus, Credit Scores derived from your credit report data, credit monitoring of selected data from your credit report and alerts. Your enrollment in a Plan with Credit Services is dependent on the credit bureaus ability to find your credit data in their records by using the personal information you provide to CreditBot and a successful identity authentication during your Enrollment. If the credit bureaus cannot find some or all your credit data, then the Credit Services we provide to you may be incomplete or in some cases not available. However, other benefits of the Plan you are enrolled in may still be available.
Authorization You understand that by enrolling in CreditBot Services, you are providing “written instructions” in accordance with the federal Fair Credit Reporting Act, as amended (“FCRA”) for CreditBot and its service providers which may include but is not limited to ConsumerInfo.com, Inc., to obtain information from your personal credit profile from Experian®, TransUnion® and Equifax®, the three major credit reporting agencies or bureaus. These written instructions authorize CreditBot, on a recurring basis, to use your Social Security number to obtain your credit related data file from any credit bureau(s) so we can deliver the Credit Services you have purchased. Delivery of your Credit Services may include but is not limited to; (a) confirming your identity, (b) providing your credit data and scores to you through the Member Site, (c) monitoring your credit data and providing certain alerts.
Credit Reports e – Your Credit Services may include one or more credit reports. These credit reports may be provided by one or more third party credit bureaus. When you use our Member Site to access your credit report(s) you agree and understand that; (a) your credit report(s) may be stored and accessible from the Member Site for a limited time not to exceed 1 year, (b) your credit report(s) may not be available to you after you cancel your Services, (c) CreditBot is not responsible for the information, accuracy or content of your credit report date file including but not limited to any associated Credit Score, (d) if you want to dispute any information found on your credit report(s), you must contact the issuing credit bureau and follow their procedure to dispute the information.
Credit Score – Your Credit Services may include access to a Credit Score from a third party service such as but not limited to FICO® or VantageScore® (“Credit Score” or “Credit Scores”). Credit Scores are available in the marketplace using many types of mathematical models. These models generally calculate your score based on information found in your credit report data file at the date and time the report data is accessed. Each third party Credit Score model has its own proprietary method of calculating your Credit Score. Credit ScoreWhen you use our Member Site to access your Credit Score(s) you agree and understand that; (a) your Credit Scores may be stored and accessible from the Member Site for a limited time, (b) your Credit Scores may not be available to you after you cancel your Services, (c) CreditBot is not responsible for the information, accuracy or content used to create your Credit Score. (d) Two common Credit Score models and their definitions include the following:
FICO Scores are developed by the Fair Isaac Corporation. The FICO Score provided by CSIdentity Corporation., (“CSID”) an affiliate of ConsumerInfo.com, Inc. also referred to as Experian Consumer Services (“ECS”), in Experian CreditWorks℠, Credit Tracker℠ and/or Your CreditBot Credit Services membership (as applicable) is based on FICO Score 8, unless otherwise noted. Many but not all lenders use FICO Score 8. In addition to the FICO Score 8, ECS and CSID may offer and provide other base or industry-specific FICO Scores (such as FICO Auto Scores and FICO Bankcard Scores). The other FICO Scores made available are calculated from versions of the base and industry-specific FICO Score models. There are many different credit scoring models that can give a different assessment of your credit rating and relative risk (risk of default) for the same credit report. Your lender or insurer may use a different FICO Score than FICO 8 or such other base industry-specific FICO Score, or another type of Credit Score altogether. Just remember that your credit rating is often the same even if the number is not. For some consumers, however, the credit rating of FICO Score 8 (or other FICO Score) could vary from the score used by your lender. The statements that “90% of the top lenders use FICO Scores” and “FICO® Scores are used in 90% of credit decisions” are based on a third-party study of all versions of FICO Scores sold to lenders, including but not limited to scores based on FICO Score 8. Base FICO Scores (including the FICO Score 8) range from 300 to 850. Industry-specific FICO Scores range from 250-900. Higher scores represent a greater likelihood that you’ll pay back your debts, so you are viewed as being a lower credit risk to lenders. A lower FICO Score indicates to lenders that you may be a higher credit risk. There are three different major credit reporting agencies – the Experian credit bureau, TransUnion and Equifax – that maintain a record of your credit history known as your credit report. Your FICO Score is based on the information in your credit report at the time it is requested . Your credit report information can vary from agency to agency because some lenders report your credit history to only one or two agencies. So, your FICO Score can vary if the information they have on file for you is different. Since the information in your report can change over time, your FICO Score may also change.
Credit Monitoring – Your Plan may include credit monitoring Credit Monitoring. Credit Monitoring may generally monitor one or more of your CreditBot provided credit bureau data files for activity that could be the precursor to credit fraud or identity theft. In some cases, you may need to manually activate your Credit Monitoring services from the Member Site. The Member Site will indicate when your Credit Monitoring has become active. If a monitored event occurs, we will attempt to electronically alert you by email and/or text. A more detailed report associated with the alert may be available from the Member Site. By agreeing to these Service Terms, you acknowledge that not all transactions or Credit Score changes will be monitored including some that may involve the potential for fraudulent use of your identity or credit. The type of Credit Monitoring we provide to you may change from time to time.
Credit Score Monitoring – Your Plan may include Active Credit Score monitoring (“Score Monitoring”). Score Monitoring may generally monitor your Credit Score(s) from one or more Credit Score providers used by CreditBot for your Services. Score Monitoring may monitor for changes and other events associated with your Credit Score. The Member Site will indicate when your Score Monitoring has become active. If a monitored event occurs, you may be electronically alerted. A more detailed report associated with the alert may be available from the Member Site. Your score may be graphically tracked and presented to you through the Member Site. By agreeing to these Service Terms, you acknowledge that not all Credit Score changes or Credit Score models will be monitored. The type of Score Monitoring we provide to you may change from time to time.
Credit Related Assistance – Your Plan may include access to an CreditBot Credit Specialist. The Credit Specialist is available to answer general questions about credit monitoring alerts, credit reports, Credit Scores, and how to dispute inaccurate information on your credit report. However, they are not allowed to provide specific credit related advice. You understand and agree that CreditBot cannot assist you directly to place fraud alerts, a credit report freeze or dispute information on your credit report.
Before you can use CreditBot Services, you must Enroll and pay fees associated with the service (“ fees”, “ costs”) associated with the Plan or Report purchase you choose. All fees must be paid in United State currency. Fees for a Plan or Report purchase may involve a one-time cost or a recurring charge based on subscription Services. If your Plan involves a recurring charge, you may be provided with the option to pay monthly, quarterly, or annually by one or more of the payment options of Credits Monitoring that may be made available to you and are listed below. A receipt for your service fees will be available from the member website and sent to the email address you maintain with us.
If your Payment Card information changes or you prefer to use an alternate Payment Card, then you are responsible to update the information at the Member Site or by calling CreditBot customer service. We reserve the right to (a) verify that your Payment Card is authorized for fees prior to processing any purchase or renewal from you, (b) access automatic updates of your Payment Card information electronically from your bank provider, (c) retry failed payments in order fulfill your Services payment obligation.
If your Payment Card fails when a service fee is charged OR your group or employer does not pay their invoice for Services on your behalf then the benefits in your Plan may be temporarily placed on hold until your payment(s) are successfully processed. (Note) Unsuccessful payment for your recurring services will accrue and does not close your account. You agree that CreditBot has no liability for third-party fees you may incur when your payment method to us fails or is rejected for any reason including insufficient funds. Example of fees you could be responsible for include overdraft and the limit charges or other bank fees.
In all cases, you are personally responsible for any local, state, federal or other taxes that may be associated with your purchases of our Services. We also reserve the right to collect such taxes at the time any purchase is processed with your Payment Card.
The terms of time that your Services will last will be provided to you when you Enroll and from your Member Site. You agree upon enrollment to be enrolled in active credit monitoring services for a year. You agree to be a continuous member of SmartCredit in good standing in order to qualify continuous active credit monitoring service. A Report and some Plans you purchase may be a one-time purchase. Other Plans are considered a recurring monthly subscription purchase. Unless you cancel, or your account is terminated, your recurring Plan will automatically continue indefinitely or until its published expiration date if applicable. You will be responsible to pay the recurring cost of the Plan when you Enroll and each month thereafter.
Cancellation & Refund
You may cancel your Services and close your account at any time using any of the following methods.
- Contact customer service by phone during regular business hours using the phone number published in the Member Site. To cancel, we must verify your identity during the call.
- When available, click the cancel button found on your member website.
- Send an email to firstname.lastname@example.org.
Once your account has been canceled any identity theft insurance and/or monitoring associated with your Services will immediately be discontinued. You may in some cases still have access to login to the Member Site to use certain features or make future purchases. However, you may not have access to the various benefits associated with the Plan you canceled such as identity protection monitoring, credit monitoring, and credit reports.
(Note) Since services are made available to your upon enrollment or purchase and costs are included by us, We do not provide refunds for the Active Credit Monitoring services. Once the services have been rendered. Your Unconditional Money-Back Guarantee is valid for our CreditBot Course/ Coaching services when you implement everything CreditBot showed you, and don’t see a change in your credit scores for 365 days of instruction, We will not only refund you – but even give you $200 for wasting your time. You will have to provide all proof via original dispute result document letters from 365 days of disputing and other related forms of documentation such as, but not limited to (bill history, related receipts for bill pay off, etc.) to receive your refund and $200.
Cancelation terms are as follows: CreditBot reserves the right to cancel or terminate Services to you upon notice and with or without cause. Notice of cancelation must be received from the client forty-eight hours before the billing date, no exceptions. Creditbot reserves the right to bill the client for the billed amount due if notice of cancellation terms are not met. These cancellation terms include, but are not limited to, offers, sales, trials, promotions, etc.
Acknowledgements & Authorizations
CreditBot reserves the right to modify these Services Terms and our Services at any time for any reason. If this Service Agreement or our Services are modified, and you are affected, then we will make a reasonable effort to notify you by posting the changes to the Member Site. To see such a posted notice, you must login to the Member Site. However, you understand and acknowledge that we have no responsibility to provide direct notice of any changes to these Service Terms or the Services you purchase. If you disagree with a change, your only option will be to cancel your Services. In order to remain a Member of Services, you must remain a continuous monthly subscriber to the SmartCredit Member in good standing.
Re-Agreement to Service Terms
In some circumstances, you may be prompted upon login to the Member Site to re-agree to these Service Terms. This could occur if the Service Terms have been modified or a period of time has elapsed since your original Plan enrollment. In such an instance, you must re-agree to the Service Terms to continue your Services. If you disagree and do not wish to re-agree to the Service Terms, then your only option will be to cancel your Services.
Services Not Offered
You acknowledge that CreditBot does not provide; legal advice, tax advice, financial advice. CreditBot is not a lender or insurance company. CreditBot is not a credit repair company. CreditBot evaluates credit files and gives determinations based on the findings contained in the report. It is solely your discretion to use CreditBot’s findings via reports or letters to use to help aid in the credit dispute process.
Outcome & Expectation of Services
You acknowledge that CreditBot is not responsible for the accuracy of your credit report, Credit Score, or any monitoring output. These benefits may be provided by third party services. You are encouraged to dispute any actual or perceived inaccuracies on your credit report by contacting the affected credit bureau. You acknowledge and agree that CreditBot will not be liable to you or your enrolled minor children or any third party based on your reliance of or use of any information we provide to you in any communication, alert, educational material, communication, website, customer service conversation or report.
Fair Credit Report Act
The FCRA allows you to obtain a copy of all the information in your consumer credit file from a consumer reporting agency for a reasonable charge. Full disclosure of information in your file at the three national credit repositories (“Repositories”) must be obtained directly from the repositories by calling:

The FCRA also states that individuals are entitled to receive a disclosure directly from the consumer reporting agency free of charge under the following circumstances:
- You certify in writing that you are unemployed and intend to apply for employment in the 60-day period beginning on the day you make the certification;
- You are on public welfare assistance;
- You have reason to believe that your file at the consumer reporting agency contains inaccurate information due to fraud; or
- You have been denied credit, insurance, or employment within the past 60 days because of your credit report.
The FCRA also permits consumers to dispute inaccurate information in their credit report without charge. Accurate information cannot be changed. You do not have to purchase your credit report or other information from CreditBot to dispute inaccurate or incomplete information in your credit file maintained by Experian, Equifax, or TransUnion.
Credit reports provided from CreditBot are not intended to constitute the disclosure of Experian, Equifax, or TransUnion information required by the FCRA or similar state laws.
The FCRA allows consumers to get one free comprehensive disclosure of all the information in their credit file from each of the credit Repositories once every 12 months through a central source. Although comprehensive, the credit reports from each of the Repositories that are available from a CreditBot Service Plan may not have the same information as a credit report obtained directly from the three Repositories or through the central source. To request your free annual report under the FCRA, you must go to www.annualcreditreport.com. You can also contact the central source to request this free annual disclosure by calling toll free 877-FACTACT (877-322-8228) or by using the mail request form available at the central source website. The Services at our Websites are not related to the free FCRA disclosure that you may be entitled to.
Consumers residing in the states of Colorado, Maine, Maryland, Massachusetts, New Jersey, and Vermont may receive an additional free copy of their credit report once per year, and residents of the state of Georgia may receive two (2) additional copies per year. For Illinois residents, credit reporting agencies are required by law to give you a copy of your credit record upon request at no charge or for a nominal fee.

Access to Services and System Requirements
To utilize and access Services you are Enrolled in you must use a computer or smart phone with internet access, a web browser and a working email address. CreditBot is not responsible in any way or form for your ability to access your email, internet or phone.
Privacy & Who May Use
You agree that You will use our Services only for your own behalf. You will be responsible for all use of your membership account and notify CreditBot immediately of any unauthorized use of your membership or the theft or misplacement of your membership access credentials.
Your Protection & Conduct
The security of your account and data is of the utmost importance. To access our Member Site, you must have a valid login user ID and password. You will receive your user ID and password after you Enroll in one of our Services for the first time. You are responsible to maintain the security and confidentiality of the password associated with your CreditBot account. If you forget or feel your password has been compromised, you may quickly reset your password by choosing the “forgot password” option at our Website login or by calling CreditBot customer service.
You acknowledge that perfect security does not exist anywhere. As such, you will not recklessly expose your social security number or other personal information to anyone that might misuse it for any purpose that would negatively affect your credit or identity. You further agree that any information you print from the Member Site, such as your credit report, will be protected in a manner like other important documents you may have. Finally, you agree that if you intend to dispose of your credit report or other printed personal information that was printed from the Member Site, that you will use a method that assures the documents cannot be reused by an unauthorized person. A sample of a reasonable method of document disposal includes a crosscut document shredder.
Portions of the delivery of our Services to you may require us to communicate with you in a variety of ways including phone, email, postal mail, or text
Methods. Examples of communications Methods that we may utilize with you include but are not limited to the following; (a) confirmations and account maintenance communications, (b) monitoring alerts (c) problem with your account, (d) special offers. Communications we send you are provided as a courtesy. Because all communications to you are provided in some way through a third-party communications provider, we cannot guarantee and are not responsible to assure communications we send you are delivered in a timely, complete manner or at all.
By enrolling in our Services, you agree that CreditBot and its employees or contractors may contact you by using any of the communications methods described above. The frequency of communications and/or alerts will vary based on the Plan you are enrolled in and the events that may occur with your account, credit, or identity information. You agree to allow us to send you communications after you cancel your service. Such communications may include but are not limited to; (a) ongoing educational information related to our Services, (b) special offers to renew or purchase CreditBot services.
If you are enrolled through a group or employee discount plan, you acknowledge and agree that CreditBot may communicate with authorized persons from your group or employer about items related to the enrollment, delivery, and payment of your Services. However, CreditBot will at no time disclosure or provide any access to any specific services such as credit data or monitoring data to your group or employer. Such communications between CreditBot and your group or employer are strictly related to the management and delivery of the group/employee discount plan. If you cancel your Services, your group or employer may be notified in order to make administrative and payment changes.
You agree to maintain up to date contact information in your account through the Member Site or by calling CreditBot client care. You acknowledge that CreditBot has no liability to you; (a) if contact information you have provided is not up to date, (b) if any third-party communication services are not working correctly or at all, (c) for third-party party charges you may incur that are associated with communications we send to you. This includes but is not limited to your third-party communications providers for data, mobile phone or land phone line plans. Text message fees and roaming charges may apply to you through your phone provider. Please contact your mobile phone provider for more details, if any, on these fees. You may have the ability to opt-out of certain communication Methods, such as texting, by changing your preferences at the Member Site or by calling CreditBot customer service.
Should you decide that you do not want CreditBot special offers, you may opt-out of communications about these offers by making changes to your personal profile at the Member Site or by contacting CreditBot customer service.
Third Party Offers & Services
You acknowledge that certain services that may be offered in your Plan, such as but not limited to checking accounts reports, may be provide by third parties. Additionally, you may be offered products, services or special offers through the Member Site or through Communications from third parties. These offers are intended to provide you with potentially discounted products or services that may compliment your services at CreditBot.
You agree and understand that these services are not provided by CreditBot and that we are not responsible for the content, offers, products or services that may be offered to you. When you click a link to any third-party websites from our Member Site you acknowledge that you are leaving the CreditBot Member site. In all cases, the link should open in a new internet browser window. Purchasing services or products is an independent decision to you at your own risk. If you click a link or visit a website associated with these third-party offers or services, you acknowledge and agree that the control and security of the third-party website is not managed or influenced by CreditBot and is not the responsibility of us. Should you decide to purchase products or enroll is such third-party services you further agree that CreditBot is not responsible in any way to the delivery, cost or management of the services or products. Customer Surveys and Reviews
By submitting any responses or content (“Responses”) to CreditBot or any third-party about CreditBot, such as survey Responses or reviews, you grant CreditBot a perpetual, royalty free, irrevocable, transferrable right to nonexclusive license to use, copy, modify, adapt, publish, translate, delete, create works, sell distribute and utilize the Responses into any form we wish throughout the United States or the World with no compensation to you. You will not have any control to review or edit Responses used by CreditBot. CreditBot reserves the right to use or not use your Responses for any other purpose at our own discretion.
If you create Responses, you agree, warrant and represent that; (a) you are the lone author and owner of the Responses, (b) all Response are accurate first hand experiences to you (c) you are a current or past customer of CreditBot, (d) your Responses will not cause injury to any person or entity, (e) you will not infringe any third-party registered mark, service mark, website look – feel – design, copyright, patent, trademark, trade secret or other proprietary rights, (f) your Responses to do violate any laws, (g) your Responses are not hateful, offensive, unlawfully threatening, harassing, defamatory or libelous to any person or entity, (h) you have not been compensated by any third-party to produce your Responses.

Limitation Of Liability
The Service and its original content, features and functionality are and will remain the exclusive property of CreditBot Ltd. Liability Company and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of CreditBot Ltd. Liability Company.

CreditBot and its respective suppliers make no warranty that; (a) the services and content are accurate, timely, uninterrupted or error-free; and (b) the results that may be obtained from the use of the Services or Content will be reliable.
You understand and agree that CreditBot and its respective suppliers will not be liable for any reason for any direct, indirect, incidental, special, consequential or exemplary damages resulting from or in any way connected to your access to, use, or inability to use the Websites, Services, membership benefits or Content, or from your access to, use, inability to use, or reliance upon any linked website, even if CreditBot or its respective suppliers have been advised of the possibility of those damages. Some jurisdictions either do not allow or place restrictions upon the exclusion or limitation of damages in certain types of agreements, and in these jurisdictions, the aforementioned limitation on liability shall be to the maximum degree permitted by applicable law. If, notwithstanding the above, liability is imposed upon CreditBot, then you agree that any such liability, regardless of the nature of the legal or equitable claim, shall not exceed the amount paid by you to CreditBot for the Service(s) you purchase from CreditBot. CreditBot is a active credit monitoring firm. CreditBot counsels there clients via reports and summaries. If the client chooses to use the reports or summaries against the credit bureaus, CreditBot holds no liability to the outcome.
In addition, the following limit of liability applies to all Services where the supplier is a credit reporting agency such as Experian®. Neither CreditBot, nor any their respective affiliates shall have any liability to you as an agent in obtaining copies of your personal credit report, credit alert report, quarterly update, or Credit Score. Neither CreditBot, nor any of their respective affiliates or credit information subcontractors make any warranty, express or implied, for the accuracy of the information contained in or provided in conjunction with the CreditBot Services you may be enrolled in. Neither CreditBot, nor any of their respective affiliates assume any liability for damages, direct or indirect, consequential or incidental, in connection with the performance of the services of your request, use or attempted use of the Servicers. Neither CreditBot nor any of their respective affiliates or credit information subcontractors are responsible for negative factual information contained in any reports you receive or as part of the Service. The aggregate liability of all such parties to you in any event is limited to the amount which you have paid CreditBot for your membership. CreditBot is a credit counseling service and does not promise to help you obtain a loan or improve your credit report, history, or rating. The terms of this section shall survive any termination, cancellation, or expiration of this agreement.

By agreeing to these Service Terms, you indemnify and hold CreditBot, its officers, directors, employees, contractors, agents, subsidiaries, joint ventures, licensees, marketing partners and other third-party affiliates harmless from any claim or demand including reasonable attorney fees made by any third-party due to our arising from your break of these Service Terms or your violation of any law or regulation or the rights of any third-party.
CreditBot controls and operates our Services and Websites from our headquarters in the United States of America. The Websites, Content and Services are not intended for sale and may not be appropriate or available for use outside of the United States or its territories. If you use the Website, Content or Services outside of the United States of America you represent and warrant; (a) you are responsible for following applicable local laws, (b) you are not located in a country that is subject to a U.S. Government embargo or has been designated a “terrorist supporting” country, (c) you are not listed on any United States Government list of prohibited or restricted persons, (d) that you are fully responsible for any local taxes or United States tariff taxes that may apply to you.

CreditBot believes that any concern or disagreement you have can be resolved by calling our customer service department during regular business hours. If your concern is not addressed, then you understand and agree that all claims, disputes or controversies between you and CreditBot, including, but not limited to tort and contract claims, claims based upon any federal, state or local statute, law, order, ordinance or regulation, and the issue of arbitrability, shall be resolved by final and binding arbitration at a location determined by the arbitrator. Any controversy concerning whether a dispute is arbitrable shall be determined by the arbitrator and not by the court. Judgment upon any award rendered by the arbitrator may be entered by any state or federal court having jurisdiction thereof. This arbitration contract is made pursuant to a transaction in interstate commerce and its interpretation, application, enforcement and proceedings hereunder shall be governed by the federal arbitration act (“FAA”). Neither you nor CreditBot shall be entitled to join or consolidate claims in arbitration by or against other consumers or arbitrate any claim as a representative or member of a class action or in a private attorney general capacity. The parties voluntarily and knowingly waive any right they have to a jury trial.
These Service Terms and Services provided hereunder will be governed by the laws of the State of California, County of Marin without regard to any laws that would direct the choice of other states laws and where applicable, will be governed by the federal laws of the United States.
